Terms of Service

These terms govern your use of the Filopic iOS app and this website (together, the “Service”), which are operated by Negoita David Alexandru (“Filopic”, “we”, “us”). By using the Service you agree to them. If you do not agree, please do not use the Service.

1. The Service

Filopic uses artificial intelligence to improve and transform photos you provide. You do not need an account: the app works with an anonymous session tied to your device. Filopic is rated 4+ on the App Store. If you are under the age of majority where you live, please use Filopic with the permission of a parent or guardian.

2. Credits and purchases

  • Generating a result uses credits. New devices receive 1 free credits, once per device.
  • More credits are sold as one-time in-app purchases through Apple. There is no subscription. Prices are shown in the app before you buy.
  • Credits have no cash value, are not transferable, and can only be used inside Filopic.
  • Credits are linked to the anonymous profile on your device. If you use Delete My Data, any unused credits are permanently removed.

3. Refunds

Credits that have been used are non-refundable. A credit is used when a result is generated, whether or not you like the result — AI output varies and we cannot guarantee a particular outcome. If a generation fails because of a technical error on our side and you were still charged a credit, contact support@filopic.com and we will restore it.

All payments are processed by Apple, so refunds for purchases are handled by Apple under its own policies. You can request one at reportaproblem.apple.com. Nothing in these terms limits refund or withdrawal rights you have under the consumer law that applies to you.

4. Your content

You keep all rights to the photos you add. You give us permission to store and process them, including through our AI provider, only to operate the Service for you. Subject to these terms and applicable law, the results Filopic generates for you are yours to use.

You are responsible for what you upload. Only add content you have the right to use, and only photos of other people when you have their permission.

5. Acceptable use

You must not use Filopic to create, upload or share content that:

  • is illegal, or promotes illegal activity;
  • sexualizes minors in any way, or is sexually explicit imagery of a real person without their consent;
  • impersonates, defames, harasses or deceives others, including misleading “deepfakes” of real people;
  • misrepresents a product you are selling, for example by hiding defects or damage;
  • is hateful, threatening, or promotes violence;
  • infringes someone else’s copyright, trademark or privacy.

You also must not attempt to bypass the credit system, reverse engineer the app, or disrupt the Service. Requests may be automatically blocked by safety filters. We may suspend or end access for anyone who breaks these rules, without refund of unused credits where the law allows.

6. AI-generated results

Results are produced by AI and may be inaccurate, unexpected or imperfect. Please review a result before you post it, use it to sell a product, or give it to someone. Your photos are processed by a third-party AI provider as described in our Privacy Policy.

7. Availability and disclaimers

The Service is provided “as is” and “as available”. We work to keep it running well, but we do not promise it will be uninterrupted or error-free, and we may change or discontinue features.

8. Limitation of liability

To the fullest extent permitted by law, Filopic is not liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the amount you paid for credits in the 12 months before the claim. This does not exclude liability that cannot be excluded by law.

9. Apple

These terms are between you and Filopic, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it. Your use of the app must also comply with the App Store terms, and Apple’s Licensed Application End User License Agreement applies where these terms are silent.

10. Changes

We may update these terms. When we do, we will change the date at the top of this page. Continuing to use Filopic after an update means you accept the new terms.

11. Governing law

These terms are governed by the laws of Romania, and disputes will be handled by the courts of Romania. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.
